The waitresses, known as “Borgata Babes,” claimed that their employer created a culture of humiliation and harassment by forcing the women to wear revealing outfits and putting weight requirements into place. According to the judge, these actions do not constitute sexual harassment.
The judge also ruled that the weight policy, which the women all agreed to and signed, is lawful and reasonable.
This is not the first time the Borgata has faced legal trouble from Borgata Babes. The Atlantic City casino also faced a $70 million lawsuit filed by two of the cocktail waitress in 2006, which was settled with a confidential settlement in 2008.
